These terms govern your use of the OpenASMR mobile application and the website at openasmr.ai (together, the "Service"). By using the Service, you agree to these terms.
1. Service Description
OpenASMR is an AI-powered application that generates personalized ASMR (Autonomous Sensory Meridian Response) audio for relaxation, sleep, and stress relief. The app uses on-device voice cloning from short reference audio to synthesize whispered sessions from AI-generated scripts.
2. Subscriptions
OpenASMR offers three tiers: Free, Pro ($9.99/month), and Max ($19.99/month). Paid subscriptions are auto-renewable and processed through the Apple App Store. Subscription management, including billing and renewals, is handled by RevenueCat on our behalf.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription through your Apple ID settings.
- Refunds are handled by Apple according to their refund policy.
3. Voice Cloning Consent
Voice cloning is a powerful technology that requires responsible use. By using the voice cloning feature, you agree that:
- You have explicit consent from the owner of any voice you clone, or you are cloning your own voice.
- You will confirm consent through the in-app dialog before each voice clone.
- For voices of deceased individuals, you have the legal right to use that voice recording.
- You will not clone voices of public figures, celebrities, or anyone who has not given you personal consent.
4. Acceptable Use
You may use OpenASMR for personal relaxation, sleep, meditation, and wellbeing. You may not use it to:
- Impersonate any person or create deepfake audio.
- Harass, threaten, or intimidate anyone.
- Create content that misrepresents a real person's speech or actions.
- Distribute cloned voice audio outside of personal use.
- Circumvent age verification or tier restrictions.
- Reverse-engineer, decompile, or extract models from the app.
Voice clones are for personal relaxation use only. There are no sharing features in the app by design.
5. Intimate Content (18+)
OpenASMR offers optional intimate content for Max tier subscribers. This content:
- Is available only to users who are 18 years or older.
- Requires age verification at openasmr.ai.
- Requires explicit opt-in via a toggle at openasmr.ai — it is never enabled by default and cannot be enabled within the iOS app.
- Consists of AI-generated fiction — text-based ASMR scripts with romantic and sensual themes. It does not feature or depict real people.
6. Intellectual Property
- Generated scripts — Scripts generated for you are your content. OpenASMR retains no rights to scripts delivered to you.
- Voice clones — Voice clones you create are your property, stored on your device. We never access them.
- The app — The OpenASMR application, its design, code, and models are the intellectual property of OpenASMR. You may not copy, modify, or redistribute them.
7. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee:
- That voice clones will achieve any particular level of similarity.
- Uninterrupted or error-free service.
- That generated scripts will meet specific expectations.
To the maximum extent permitted by law, OpenASMR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
8. Account Termination
We may suspend or terminate your account if you:
- Violate these terms of service.
- Use voice cloning without proper consent.
- Engage in impersonation or harassment.
- Circumvent content restrictions or age verification.
You may delete your account at any time at openasmr.ai/account. Account deletion removes all server-side data. Voice data on your device is yours to manage.
9. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email or through the app at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
10. Governing Law
These terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions.
